Platform Terms of Service

These Terms of Service apply to shop owners (tenants) who use the Summon3D platform to run their 3D printing businesses.

If you are a customer ordering from a shop, please refer to that shop's individual terms of service.

These Platform Terms of Service ("Terms") govern your use of Summon3D's SaaS platform and services. By creating an account or using our platform, you agree to be bound by these Terms. Please read them carefully.

1. Agreement to Terms

By accessing or using Summon3D ("we", "us", "our"), you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the platform.

These Terms constitute a legally binding agreement between you (the "Shop Owner" or "you") and Summon3D. You represent that you have the authority to enter into this agreement.

2. Eligibility and Account Creation

Age Requirement

You must be at least 18 years old to use Summon3D. By creating an account, you represent that you meet this age requirement.

Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

Legal Business Requirement

You represent that you are operating a legitimate 3D printing business and have the legal authority to enter into contracts and accept payments. You must comply with all applicable business registration, licensing, and tax requirements in your jurisdiction.

Identity Verification

We reserve the right to verify your identity and business information at any time. You may be required to provide government-issued identification, proof of address, business registration documents, or other verification materials. Failure to provide requested verification may result in account suspension or termination.

Account Security

You must immediately notify us of any unauthorized use of your account. We recommend enabling multi-factor authentication (MFA) for additional security.

One Account Per Shop

You may create one account per 3D printing business. Creating multiple accounts to circumvent usage limits or restrictions is prohibited and may result in account termination.

3. Subscription Plans and Billing

Pricing Model

Summon3D operates on a transaction-based pricing model. All features are available to all users. Current pricing is available on our website.

Platform Fees

Summon3D charges a 7% platform fee on each successful transaction processed through your shop. This fee is automatically deducted from each payment before funds are transferred to your Stripe account.

  • Platform Fee: 7% of transaction total (charged by Summon3D)
  • Payment Processing: ~2.9% + $0.30 per transaction (charged by Stripe)
  • Total Fees: Approximately 10% per order

The platform fee applies to the total order amount including product costs and shipping. Fees are non-refundable, even if the underlying transaction is later refunded.

Fee Calculation Example

On a $100 order: Customer pays $100 → Stripe takes ~$3.20 (2.9% + $0.30) → Summon3D takes $7.00 (7%) → You receive ~$89.80.

Subscription Tiers (Optional)

We may offer optional subscription plans that reduce or eliminate platform fees in exchange for a monthly subscription. Details of available plans and pricing will be displayed on your dashboard if available.

Fee Changes

We reserve the right to change our fee structure. We will notify you at least 30 days before any fee increase takes effect. Continued use of the platform after a fee change constitutes acceptance of the new fees.

"Powered by Summon3D" Branding

Free accounts include a small "Powered by Summon3D" watermark on shop pages. This branding may be removed through subscription upgrades when available.

4. Stripe Connect and Payment Processing

Stripe Connect Standard

To accept payments from customers, you must create a Stripe Connect account. You will have a direct relationship with Stripe, and Stripe's terms apply to your use of their services. Review Stripe's Connected Account Agreement.

Payment Responsibility

You are responsible for all transactions with your customers, including refunds, chargebacks, and disputes. Summon3D is not a party to these transactions and has no liability for payment issues.

Account Verification

Stripe may require identity verification and business documentation. Failure to complete verification may result in account limitations or closure.

Fraud Prevention Requirements

You agree to implement and maintain reasonable fraud prevention measures, including but not limited to:

  • Verifying customer identity when transactions appear suspicious
  • Monitoring for unusual order patterns or volumes
  • Refusing orders that appear fraudulent or high-risk
  • Cooperating with fraud investigations by Stripe or law enforcement
  • Reporting suspected fraud to Summon3D immediately
  • Maintaining accurate records of all transactions and communications

Prohibited Payment Activities

You may not use the payment system for:

  • Money laundering or terrorist financing
  • Processing payments for third parties not related to your 3D printing business
  • Self-dealing or circular transactions to generate fake revenue
  • Accepting payments for goods or services you cannot or do not intend to deliver
  • Splitting transactions to avoid fraud detection thresholds
  • Using stolen or unauthorized payment credentials

Chargeback Responsibility

You are solely responsible for all chargebacks and disputes. High chargeback rates may result in account suspension or termination. Stripe may hold funds in reserve to cover potential chargebacks. We recommend maintaining clear communication with customers and providing tracking information for all orders.

Account Suspension for Fraud

We reserve the right to immediately suspend your account and withhold funds if we detect or suspect fraudulent activity, excessive chargebacks, or violation of payment terms. Suspended accounts may be reported to Stripe and law enforcement as appropriate.

5. Your Responsibilities as a Shop Owner

As a shop owner using Summon3D, you agree to:

  • Comply with Laws: Operate your business in compliance with all applicable federal, state, and local laws and regulations
  • Prohibited Items: Refuse to print firearms, weapons, illegal items, or items that infringe intellectual property rights
  • Customer Privacy: Maintain your own privacy policy and comply with data protection laws (GDPR, CCPA, etc.)
  • Terms of Service: Maintain clear terms of service with your customers (we provide a template)
  • Quality Standards: Provide reasonable quality 3D printing services to your customers
  • Timely Communication: Respond to customer inquiries and order updates in a reasonable timeframe
  • Accurate Information: Provide accurate shop information, pricing, and production times
  • Shipping Compliance: Use your own EasyPost account and comply with shipping regulations
  • Tax Obligations: Collect, report, and remit all applicable taxes (sales tax, VAT, etc.)
  • Customer Disputes: Handle customer disputes, refunds, and chargebacks professionally
  • Content Rights: Only use images, text, and branding that you own or have rights to use

6. Data Ownership and Privacy

Your Customer Data

You own all customer data collected through your shop. Summon3D acts as a data processor on your behalf. You are the data controller and are responsible for compliance with data protection laws.

Platform Data Collection

We collect data about your use of the platform (analytics, usage metrics, feature adoption) to improve our services. See our Privacy Policy for details.

Data Portability

You may export your shop data, customer data, and orders at any time through your dashboard or by contacting support.

Data Retention After Termination

If you close your account, we will retain order data for 30 days to allow for final settlements and dispute resolution. After 30 days, all data will be permanently deleted except where required by law.

7. Prohibited Activities

You may not use Summon3D to:

Prohibited Items & Activities

  • Print or facilitate printing of firearms, weapons, or weapon parts
  • Engage in illegal activities or facilitate illegal activities
  • Infringe on intellectual property rights
  • Distribute malware, viruses, or harmful code
  • Use the platform for phishing, spam, or fraud
  • Impersonate others or provide false information

Payment & Financial Fraud

  • Engage in money laundering, terrorist financing, or other financial crimes
  • Process fraudulent transactions or use stolen payment credentials
  • Create fake orders or self-dealing transactions to manipulate revenue
  • Accept payments for goods or services you cannot or will not deliver
  • Evade fraud detection systems or split transactions to avoid thresholds
  • Operate your shop as a front for illegal money movement
  • Falsify business information to obtain a Stripe account

Platform Abuse

  • Attempt to gain unauthorized access to our systems
  • Scrape, crawl, or reverse-engineer the platform
  • Circumvent usage limits or restrictions
  • Resell or sublicense access to the platform
  • Use the platform in a way that harms Summon3D's reputation

Violation of these prohibitions may result in immediate account termination without refund, forfeiture of pending funds, and reporting to law enforcement where applicable.

8. Intellectual Property

Summon3D Ownership

Summon3D and all platform features, design, code, and branding are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works.

Your Content

You retain ownership of all content you upload (shop branding, portfolio images, product descriptions). You grant Summon3D a license to display this content on the platform and in marketing materials (with your permission).

DMCA Compliance

If you believe content on the platform infringes your copyright, please contact us at support@summon3d.com with details. We will investigate and take appropriate action.

9. Third-Party Services

Summon3D integrates with third-party services. Your use of these services is subject to their terms:

  • Stripe: Payment processing and Stripe Connect ( Stripe Terms )
  • EasyPost: You provide your own API key ( EasyPost Terms )
  • Supabase: Database and authentication hosting
  • Brevo: Transactional email delivery

We are not responsible for third-party service outages, errors, or changes to their terms.

10. Service Availability and Support

Uptime

We strive to maintain high availability but do not guarantee 100% uptime. Scheduled maintenance will be announced in advance when possible. We are not liable for losses due to downtime.

Support

Support is provided via email (support@summon3d.com). Response times vary by subscription tier. Premium tiers receive priority support.

Platform Changes

We may modify, update, or discontinue features at any time. We will notify you of material changes that significantly affect your use of the platform.

11. Termination

Termination by You

You may terminate your account at any time by canceling your subscription and deleting your account from your dashboard. All data will be deleted within 30 days.

Termination by Summon3D

We may suspend or terminate your account immediately if you violate these Terms, engage in prohibited activities, or for non-payment. We will provide notice when possible, but immediate termination may occur for serious violations.

Effect of Termination

Upon termination, your access to the platform will be revoked. Your shop will no longer be accessible to customers. You remain responsible for any outstanding fees, customer obligations, and disputes.

12. Disclaimers and Limitation of Liability

AS-IS SERVICE

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUMMON3D SHALL NOT BE LIABLE FOR:

  • Loss of profits, revenue, data, or business opportunities
  • Indirect, incidental, special, consequential, or punitive damages
  • Damages arising from customer disputes, chargebacks, or refunds
  • Third-party service failures (Stripe, EasyPost, Supabase, etc.)
  • Data loss due to platform errors or your own actions
  • Downtime, bugs, or service interruptions
  • Your failure to comply with laws or these Terms

IN NO EVENT SHALL SUMMON3D'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Important: Summon3D is a platform provider. We are not responsible for your customer relationships, order quality, shipping, refunds, or disputes.

13. Indemnification

You agree to indemnify, defend, and hold harmless Summon3D, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

  • Your use of the platform or violation of these Terms
  • Your customer relationships, orders, or products
  • Intellectual property infringement by you or your customers
  • Your violation of any laws or regulations
  • Printing of prohibited items (firearms, weapons, illegal content)
  • Customer disputes, injuries, or damages from printed items
  • Your privacy policy or data handling practices
  • Tax obligations or non-compliance

14. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to a jury trial and class action lawsuits.

Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or violation of confidentiality obligations.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email and/or a dashboard notification at least 30 days before they take effect. The "Last Updated" date at the top indicates when these Terms were last revised. Continued use of the platform after changes constitutes acceptance of the updated Terms.

16. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Summon3D.

Severability

If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
